The Appeal – Successful appellate litigation requires detailed scrutiny of the thousands of pages of documents generated during the course of litigation in the lower courts. Your appellate attorney should know the rules of procedure, be able to identify legal errors, draft a compelling appellate brief, redirect the judges’ attention in reply to the opposing party’s response, and persuade judges through compelling oral argument. Also Appealing – In order to maximize your chance of success, your appellate attorney should be consulted during the course of litigation in the lower courts to ensure that a proper record is created and to assist in the preparation of pleadings, motions, and in trial strategy. Before trial, your appellate will assist in preparing motions and briefs to ensure that issues on which cases are often reversed are not overlooked and are preserved.

For example, ensuring that bench conferences are transcribed, objections are properly made, and that the court makes rulings to which your trial team can object.
